Terms of Service

1. Acceptance of Terms

By using Muscadine ("the Service"), operated at muscadine.wymzy.ai by WYMZY INDUSTRIES LLC, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Muscadine is a file and photo sharing platform for professionals. Upload files, organize them into branded galleries, and share with clients via a link — no account required for recipients. Files are stored on Cloudflare R2.

3. Accounts

You must create an account with a valid email and password. You must be at least 18 years of age. You are responsible for all activity under your account.

4. Subscriptions & Billing

Muscadine offers two plans:

• Regular — $4.99/month (5 GB storage, unlimited galleries)
• AI — $9.99/month (25 GB storage, AI auto-tagging, custom domains)

Billed monthly via Stripe. Cancel anytime from settings. Access continues through the end of your billing period. No prorated refunds.

5. User Content

You retain ownership of all files you upload. By using the Service, you grant WYMZY a license to host, store, and deliver your files solely to operate the Service. This license terminates when you delete your content or account.

You must not upload files that are illegal, infringe on intellectual property rights, contain malware, or violate any applicable law.

6. Storage Limits

Regular plans include 5 GB of storage. AI plans include 25 GB. If you exceed your limit, new uploads will be blocked until you delete files or upgrade your plan.

7. Acceptable Use

You agree not to use Muscadine to:

• Store or distribute illegal content
• Share copyrighted material without authorization
• Use the Service for bulk file hosting or CDN replacement
• Attempt to circumvent storage limits or access controls
• Distribute malware or harmful files

8. Intellectual Property

The Muscadine name, logo, branding, and technology are the exclusive property of WYMZY INDUSTRIES LLC.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted access, file preservation beyond reasonable measures, or AI accuracy.

10. Limitation of Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT, OR $50, WHICHEVER IS GREATER.

11. Governing Law

Governed by the laws of the State of Arkansas. Legal actions in Union County, Arkansas.
